TRANSFORMASI PARADIGMA PENJAMINAN MUTU PENDIDIKAN TINGGI INDONESIA: ANALISIS KESENJANGAN HUKUM TRANSISI PERMENDIKTISAINTEK NOMOR 39 TAHUN 2025 DAN STRATEGI IMPLEMENTASI MUTU

Abstract


The implementation of higher education quality assurance in Indonesia is currently facing a fundamental shift following the enactment of the Regulation of the Minister of Higher Education, Science, and Technology (Permendiktisaintek) Number 39 of 2025. This regulation replaces the previous framework, Permendikbudristek Number 53 of 2023, which aimed at simplifying national standards. This research aims to analyze the legal gaps arising from the rapid transition between these two regulations and the institutional readiness of universities to adapt to the new "Global Quality" orientation. Using a normative-conceptual approach, this study identifies a significant gap between the normative requirement for universities to exceed National Higher Education Standards (SN Dikti) and the empirical reality of administrative and financial constraints, particularly for private higher education institutions. The analysis highlights three main issues: the legal consequences of the two-year transition period, the problematic funding and independence of Independent Accreditation Agencies (LAM), and the challenges of integrating data with the Higher Education Database (PD Dikti). The findings suggest that while the new regulation provides greater flexibility, it requires a robust internal quality culture and a realistic roadmap for digital infrastructure to bridge the gap between compliance and excellence.
