Focus and Scope

Legalitas: Jurnal Ilmiah Ilmu Hukum is an open access and peer-reviewed journal that aims to offer an international academic platform for cross-border legal research in goverment regulation, particularly in developing and emerging countries. These may include but are not limited to various fields such as: the practice of international law, human rights law, civil law, criminal law, constitutional and administrative law, legal pluralism governance, and another section related to contemporary issues in legal scholarship. 

The journal sets up specific topic to be covered in each issue which can be analyzed from many perspective of laws as mentioned. However, in each issue we also accommodate latest issue of legal development in general

Peer Review Process

Submitted paper will be firstly reviewed by the editors to determine whether the paper meet the edition theme and submission guidelines. Papers which meet the theme and the guidelines will be assigned to selected reviewers for peer-reviews. Legalitas: Jurnal Ilmiah Ilmu Hukum is a double blind peer-reviewed journal which involves reviewers based on their experties relevant to the topic of the paper. Final decision of paper acceptance is solely decided by the editors according to reviewers' comment.

In short, the steps are:

  1. Manuscript Submission (by author) 
  2. Manuscript Check and Selection (by editors). Editors have a right to directly accept, reject, or review according to standart set up by Legalitas: Jurnal Ilmiah Ilmu Hukum. Prior to further processing steps, plagiarism check using Turnitin is applied for each manuscript.
  3. Manuscript Reviewing Process (by reviewers) 
  4. Notification of Manuscript Acceptance, Revision, or Rejection (by editor to author based on reviewers comments)
  5. Paper Revision (by author)
  6. If the editor seems to be satisfied with revision, notification for acceptance (by editor). 
  7. Editing and Proof reading (by editor)
  8. Publishing process (by editor)

The steps point number 1 to 5 are considered as 1 round of the peer-reviewing process. The editor or editorial board considers the feedback provided by the peer reviewers and arrives at a decision. The following are the most common decisions:

  • Accepted, as it is. The journal will publish the paper in its original form;
  • Accepted by Minor Revisions, the journal will publish the paper and asks the author to make small corrections (let authors revised with stipulated time);
  • Accepted by Major Revisions, the journal will publish the paper provided the authors make the changes suggested by the reviewers and/or editors (let authors revised with stipulated time);
  • Resubmit (conditional rejection), the journal is willing to reconsider the paper in another round of decision making after the authors make major changes;
  • Rejected (outright rejection), the journal will not publish the paper or reconsider it even if the authors make major revisions.

 

Open Access Policy

This journal provides immediate open access to its content on the principle that making research freely available to the public supports a greater global exchange of knowledge.

 

Archiving

This journal utilizes the LOCKSS system to create a distributed archiving system among participating libraries and permits those libraries to create permanent archives of the journal for purposes of preservation and restoration. More...

 

Plagiarism Policy

  • Plagiarism and self-plagiarism are not allowed;
  • The authors should ensure that they have written entirely original works, and if the authors have used the work and/or words of others that this has been appropriately cited or quoted;
  • An author should not in general publish manuscripts describing essentially the same research in more than one journal or primary publication. Submitting the same manuscript to more than one journal concurrently constitutes unethical publishing behavior and is unacceptable;
  • Proper acknowledgment of the work of others must always be given. Authors should cite publications that have been influential in determining the nature of the reported work.

Working Process:

  1. Editorial Team checking manuscript on offline and online database manually (checking proper citation and quotation);
  2. Editorial Team checking manuscript by using Turnitin app. If it is found plagiarism indication (more than 25%), the board will reject the manuscript immediately.

 

Article Processing Charges (APCs)

Legalitas: Jurnal Ilmiah Ilmu Hukum welcomes article submissions and does not charge Article Processing Charges (APCs).

Article Submission: 0.00 (USD)
Authors are not required to pay an Article Submission Fee as part of the submission process to contribute to review costs.

Article Publication Charges (APCs): 0.00 (USD)
For Libraries/Individuals, can read and download any full-text articles for free of charge.

 

Copyright Transfer Agreement

To be published in Legalitas: Jurnal Ilmiah Ilmu Hukum and publish and distribute research articles, editors need publishing rights (transferred from author to publisher). This agreement relates to the transfer/publishing copyright license to Legalitas: Jurnal Ilmiah Ilmu Hukum, but the authors still have significant rights to use and share their published articles.

Legalitas: Jurnal Ilmiah Ilmu Hukum supports the need for writers to share, disseminate and maximize the impact of their research and these rights in any database. As a journal article writer, you have the right to various uses of your articles, including the institution or company where you work. Copyrights can be used without the need for special permission. Authors who publish articles in the Legalitas: Jurnal Ilmiah Ilmu Hukum have broad rights to use their work for teaching and scientific purposes without asking for permission, including:


• use the author for lectures, presentations, or conferences and distribute copies to participants;
• distribution to colleagues for research use;
• used in compilations of the author's subsequent work;
• be included in a thesis or dissertation;
• reuse of sections or excerpts from articles in other works (with complete acknowledgments of the final article);
• preparation of derivative works (for any purpose, including commercial purposes, as long as they give appropriate credit, provide a link to the license, and indicate if changes were made) (with full acknowledgment of the final article);
• voluntary posting on open websites operated by authors or writers' agencies for scientific purposes
The Authors submitting a manuscript do so on the understanding that if accepted for publication, the copyright for publishing (publishing right) of the article shall be assigned/transferred to Legalitas: Jurnal Ilmiah Ilmu Hukum

Retraction & Correction

Retraction & Correction (R & C) Policy

We understand that the authors have worked carefully preparing manuscripts, and we have carried out peer-review processes. However, sometimes there is the potential for published articles to be withdrawn or deleted for scientific reasons. It should not be done lightly and can only occur under extraordinary circumstances. Therefore, corrections, clarifications, retractions, and apologies when needed will be carried out with strict standards to maintain confidence in the authority of its electronic archives. Our commitment and policy are to maintain the integrity and completeness of important scientific records for researchers and librarians' archives.

 

Article Retraction

Legalitas: Jurnal Ilmiah Ilmu Hukum is committed to playing its part in maintaining the integrity of the scholarly record; therefore, on occasion, it is necessary to retract articles. Articles may be retracted if:

•There is a major scientific error that would invalidate the article's conclusions, for example, where there is clear evidence that findings are unreliable, either as a result of misconduct (e.g., data fabrication) or honest error (e.g., miscalculation or experimental error).

•The findings have previously been published elsewhere without proper cross-referencing, permission, or justification (i.e., cases of redundant publication).

•There are ethical issues such as plagiarism (appropriation of another person's ideas, processes, results, or words without giving appropriate credit, including those obtained through confidential review of others' manuscripts) or inappropriate authorship.

To ensure that retractions are handled according to publication best practice and following COPE retraction guidelinesLegalitas: Jurnal Ilmiah Ilmu Hukum adopts the following retraction process:

• An article requiring potential retraction is brought to the journal editor's attention.

• The journal editor should follow the step-by-step guidelines according to the COPE flowcharts (including evaluating a response from the author of the article in question).

• Before any action is taken, the editor's findings should be sent to the Ethics Advisory Board. The purpose of this step is to ensure a consistent approach in accordance with industry best practices.

• The final decision as to whether to retract is then communicated to the author and, if necessary, any other relevant bodies, such as the author's institution on occasion.

• The retraction statement is then posted online and published in the next available issue of the journal (see below for more details of this step).

Note that if authors retain the copyright for an article, this does not mean they automatically have the right to retract it after publication. The integrity of the published scientific record is of paramount importance, and COPE’s Retraction Guidelines still apply in such cases.

Article Correction

Legalitas: Jurnal Ilmiah Ilmu Hukum should consider issuing a correction if:

• A small part of an otherwise reliable publication reports flawed data or proves to be misleading, especially if this is the result of honest error.

• The Author or Contributor list is incorrect (e.g., a deserving author has been omitted or someone who does not meet authorship criteria has been included).

Corrections to peer-reviewed content fall into one of three categories:

• Publisher correction (erratum): to notify readers of a critical error made by publishing/journal staff (usually a production error) that has a negative impact on the publication record or the scientific integrity of the article, or on the reputation of the Authors or the journal.

• Author correction (corrigendum): to notify readers of an important error made by the Authors, which negatively impacts the publication record or the scientific integrity of the article or the reputation of the Authors or the journal.

• Addendum: an addition to the article by its Authors to explain inconsistencies, to expand the existing work, or otherwise explain or update the information in the main work.

The decision of whether a correction should be issued is made by the Editor(s) of a journal, sometimes with advice from Reviewers or Editorial Board members. Handling Editors will contact the Authors of the paper concerned with a request for clarification, but the final decision about whether a correction is required and which type rests with the Editors.

 

Article Removal

In an extremely limited number of cases, it may be necessary to remove a published article from our online platform. This will only happen if an article is clearly defamatory, or infringes others’ legal rights, or where the article is, or we have good reason to expect that it will be, the subject of a court order, or where the article if acted upon, may pose a serious health risk. In such circumstances, while the article's metadata (i.e., title and author information) will be retained, the text will be replaced with a screen indicating that the article has been removed for legal reasons.

Article Replacement

In cases where an article, if acted upon, may pose a serious health risk, the Authors of the original paper may wish to retract the flawed original and replace it with a corrected version. Under such circumstances, the above procedures for retraction will be followed with the difference that the article retraction notice will contain a link to the corrected re-published article together with a history of the document.

 

Publication Ethics

LEGALITAS : Jurnal Ilmiah Ilmu Hukum, is committed to upholding the highest standards of publication ethics and takes all possible measures against any publication malpractices. The Editorial Board is responsible for, among others, preventing publication malpractice. Unethical behavior is unacceptable, and the LEGALITAS : JURNAL ILMIAH ILMU HUKUM does not tolerate plagiarism in any form. Authors who submitted articles: affirm that manuscript contents are original. Furthermore, the authors’ submission also implies that the manuscript has not been published previously in any language, either wholly or partly, and is not currently submitted for publication elsewhere. Editors, authors, and reviewers, within the LEGALITAS : JURNAL ILMIAH ILMU HUKUM are to be fully committed to good publication practice and accept the responsibility for fulfilling the following duties and responsibilities, as set by the COPE Code of Conduct for Journal Editors. As part of the Core Practices, COPE has written guidelines on the http://publicationethics.org/resources/guidelines.

Section A: Publication and authorship 

  1. All submitted papers are subject to a strict peer-review process by reviewers that are experts in the area of the particular manuscript.
  2. The review process is double-blind peer-review.
  3. The factors that are taken into account in the review are relevance, soundness, significance, originality, readability, and language.
  4. The possible decisions include acceptance, acceptance with revisions, or rejection.
  5. If authors are encouraged to revise and resubmit a submission, there is no guarantee that the revised submission will be accepted.
  6. Rejected articles will not be re-reviewed.
  7. The paper acceptance is constrained by such legal requirements as shall then be in force regarding libel, copyright infringement, and plagiarism.
  8. No research can be included in more than one publication. 

Section B: Authors’ responsibilities

  1. Authors must certify that their manuscripts are their original work.
  2. Authors must certify that the manuscript has not previously been published elsewhere.
  3. Authors must certify that the manuscript is not currently being considered for publication elsewhere. 
  4. The authors must participate in the peer-review process. 
  5. Authors are obliged to provide retractions or corrections of mistakes.
  6. All Authors mentioned in the paper must have significantly contributed to the research.
  7. The authors must state that all data in the paper are real and authentic.
  8. The authors must notify the Editors of any conflicts of interest.
  9. The authors must identify all sources used in the creation of their manuscripts.
  10. Authors must report any errors they discover in their published papers to the Editors. 

Section C: Reviewers’ responsibilities

  1. Reviewers should keep all information regarding papers confidential and treat them as privileged information. 
  2. Reviews should be conducted objectively, with no personal criticism of the author.
  3. Reviewers should express their views clearly with supporting arguments.
  4. Reviewers should identify relevant published work that has not been cited by the authors.
  5. Reviewers should also call to the Editor in Chief’s attention any substantial similarity or overlap between the manuscript under consideration and any other published paper of which they have personal knowledge.
  6. Reviewers should not review manuscripts in which they have conflicts of interest resulting from competitive, collaborative, or other relationships or connections with any of the authors, companies, or institutions connected to the papers. 

Section D: Editors’ responsibilities

  1. Editors have complete responsibility and authority to reject/accept an article.
  2. Editors are responsible for the contents and overall quality of the publication.
  3. Editors should always consider the needs of the authors and the readers when attempting to improve the publication.
  4. Editors should guarantee the quality of the papers and the integrity of the academic record.
  5. Editors should publish errata pages or make corrections when needed.
  6. Editors should have a clear picture of research funding sources.
  7. Editors should base their decisions solely on the papers’ importance, originality, clarity, and relevance to the publication’s scope.
  8. Editors should not reverse their decisions nor overturn the ones of previous editors without serious reason. 
  9. Editors should preserve the anonymity of reviewers. 
  10. Editors should ensure that all research material they publish conforms to internationally accepted ethical guidelines.
  11. Editors should only accept a paper when reasonably certain.
  12. Editors should act if they suspect misconduct, whether a paper is published or unpublished, and make all reasonable attempts to persist in obtaining a resolution to the problem.
  13. Editors should not reject papers based on suspicions; they should have proof of misconduct.
  14. Editors should not allow any conflicts of interest between staff, authors, reviewers, and board members.
