PERLINDUNGAN NASABAH DARI KLAUSUL TIDAK ADIL DALAM PERJANJIAN KREDIT BAKU: A NARRATIVE LITERATUR REVIEW

Abstract


Perjanjian  kredit baku sering mengandung klausul yang secara tidak adil memberikan keuntungan  lebih kepada lembaga keuangan sementara memposisikan nasabah dalam situasi rentan. Penelitian ini bertujuan untuk mengkaji literatur mengenai jenis klausul tidak adil dalam perjanjian kredit tidak baku dan strategi yang dapat dilakukan sebagai upaya perlindungan nasabah dari klausul tidak adil dalam perjanjian kredit. Penelitian ini menggunakan pendekatan  narrative literatur review (NLR) dengan menitik beatkan kajian pada berbagai sumber, seperti artikel dari berbagai jurnal yang telah diterbitkan dan berbagai sumber lain yang relevan dengan topik kajian. Hasil NLR menunjukkan bahwa terdapat beberapa jenis klausul tidak adil dalam perjanjian kredit baku, yaitu klausul pembatalan sepihak, klausul suku bunga yang tidak transparan, dan klausul perubahan ketentuan tanpa pemberitahuan. Untuk menghadapi klausul- klausul tidak adil tersebut, maka diperlukan berbagai strategi perlindungan nasabah, yaitu antara lain regulasi yang ketat, pendidikan dan kesadaran nasabah, serta melembagakan standar etika.
